1. About BlueMax and these terms
BlueMax Technology Support Ltd (“BlueMax”, “we”, “us” or “our”) is registered in England and Wales under company number 12902082. Our registered office is R1.6 Fen House, Fen Road, Cambridge, Cambridgeshire, England, CB4 1UN.
These terms, the accepted quotation and any written variation form the contract. If the quotation expressly conflicts with these terms, the quotation takes priority for that specific matter. Nothing in these terms removes rights that cannot lawfully be excluded, including a consumer’s statutory rights.
2. Residential and commercial customers
A consumer is an individual acting mainly outside their trade, business, craft or profession. A commercial customer is any customer acting for business purposes, including a company, partnership, landlord acting as a business, charity or public body.
Some provisions apply differently to consumers and commercial customers. Where consumer law gives a consumer greater protection, that law prevails.
3. Quotations
A quotation is based on information available when it is prepared, including property details, photographs, survey observations, requested coverage and assumed access. Unless the quotation states another period, it remains open for acceptance for 30 days.
Quoted prices include the equipment and work expressly listed. Additional cameras, specialist access equipment, unusually long or concealed cable routes, groundworks, electrical work, network remediation, building repairs, permits, parking, congestion charges and other non-standard requirements are excluded unless stated.
If previously unknown conditions become apparent, we will explain the issue and obtain agreement to any price or scope change before carrying out the additional work, except where immediate action is reasonably necessary for safety.
4. Booking and contract formation
An enquiry or provisional date is not a confirmed booking. The contract is formed when the customer accepts the quotation in the requested way and BlueMax confirms acceptance, subject to receipt of any stated deposit.
The customer must check the quotation, contact details, equipment, camera count, recording requirements and scope before accepting it. A person accepting for an organisation confirms that they have authority to bind that organisation.
5. Deposits
If a deposit is required, the amount and payment date will be shown in the quotation. A deposit reserves installation capacity and may also fund equipment ordered for the project. We will not treat a deposit as automatically non-refundable.
If the customer cancels, BlueMax may retain or recover only an amount that is lawful and reasonable in the circumstances, taking account of work completed, non-recoverable commitments and actual loss, less costs saved or equipment that can reasonably be reused or returned. Consumer cancellation rights in section 11 apply.
6. Payment
Payment stages and methods are set out in the quotation or invoice. Unless agreed otherwise, the balance is due when the installation is completed and demonstrated. Commercial credit terms apply only where confirmed in writing.
The customer must raise a genuine invoice query promptly and pay any undisputed amount on time. BlueMax may charge statutory interest and recovery costs on overdue commercial debts where the law permits. For consumers, any late-payment charge must reflect reasonable costs and applicable law.
Title to supplied equipment remains with BlueMax until the price due for that equipment is paid in full, to the extent legally enforceable. This does not permit BlueMax to enter a consumer’s premises or remove installed equipment without lawful authority.
7. Installation dates and delays
We will agree a proposed installation date or window. Dates are given in good faith but may need to change because of weather, illness, supply problems, unsafe conditions, access issues or events outside reasonable control. Unless expressly agreed in writing, time is not of the essence.
We will notify the customer of a material delay and arrange a reasonable alternative. A consumer retains any legal right to require performance within an additional reasonable period or to cancel where the law allows.
8. Customer responsibilities
The customer must:
- provide accurate information about the property, intended use and known hazards;
- confirm that they own the property or have all necessary landlord, freeholder, planning, listed-building, employer or third-party permissions;
- identify concealed services, asbestos, fragile surfaces, alarms and other material risks known to them;
- provide suitable electricity, broadband, router access and compatible mobile devices where these are needed for the agreed system;
- keep children, pets, occupants and other contractors clear of the work area;
- back up information and configuration on customer-owned devices where appropriate; and
- operate the CCTV system lawfully after handover, including considering privacy, signage, audio recording, neighbouring property, workplace monitoring and data-subject requests.
9. Access requirements and site conditions
The customer must provide safe, timely access to the property, agreed work areas, power, network equipment and any relevant keys or codes. Standard pricing assumes reasonable access at standard working heights with suitable ground and fixing surfaces.
BlueMax may pause or refuse work that would be unsafe, unlawful, materially different from the surveyed conditions or likely to damage the property unreasonably. Waiting time, repeat visits or additional equipment caused by unavailable or unsafe access may be charged if explained and reasonably incurred.
10. Equipment, positioning and performance
Camera positioning is agreed to provide practical coverage, but CCTV cannot guarantee prevention, detection, identification, uninterrupted recording or recovery of every event. Image quality and alerts depend on lighting, weather, scene movement, positioning, network conditions, device settings and other factors.
Where a specified product becomes unavailable, BlueMax may propose an equivalent or better alternative. No substitution will be made without agreement where it materially changes appearance, functionality or price.
Storage duration is an estimate because it varies with camera count, resolution, frame rate, compression, recording schedule and scene activity. Internet and mobile access depend on third-party services and customer connectivity.
11. Consumer cancellation rights
If a consumer contract is concluded at a distance or away from BlueMax’s business premises, the consumer may have a statutory 14-day cancellation period beginning when the service contract is made. The customer will receive any information required by law for the particular contract.
If a consumer asks us to start work during a cancellation period, we may require an express request. If the consumer then cancels, they may have to pay a proportionate amount for services supplied up to cancellation. If the service has been fully performed during the cancellation period after the consumer’s express request and acknowledgement, the statutory cancellation right may end.

12. Other cancellation and rescheduling
A customer should give as much notice as reasonably possible. If a confirmed visit is cancelled or cannot proceed because access or essential site information was not provided, BlueMax may recover reasonable, evidenced loss caused by that cancellation, subject to consumer law.
BlueMax may cancel or suspend the contract for serious or repeated non-payment, unsafe or unlawful conditions, abusive conduct, inability to obtain essential equipment, or a material customer breach that is not remedied after reasonable notice. We will refund sums paid for work not supplied, less any lawful deduction.
13. Completion and handover
On completion, BlueMax will test the agreed core functions and provide a practical demonstration. The customer should identify any visible concern promptly. Signing a completion note does not remove rights concerning defects that could not reasonably have been identified at handover.
The customer is responsible for keeping passwords secure, maintaining access to recovery email or telephone accounts and following reasonable update, cleaning and maintenance guidance.
14. Warranty and statutory rights
Qualifying BlueMax installations include the written Three-Year On-Site Replacement Warranty. That warranty explains coverage, exclusions and the claims process.
For consumers, equipment must be as described, of satisfactory quality and fit for a disclosed purpose, and services must be performed with reasonable care and skill, subject to applicable law. The BlueMax warranty is additional to, and does not replace, those rights.
15. Liability
Nothing in the contract excludes or limits liability where it would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer’s non-excludable statutory rights.
BlueMax is responsible for reasonably foreseeable loss caused by its breach of contract or failure to use reasonable care and skill. BlueMax is not responsible for loss caused by inaccurate customer information, customer misuse, third-party equipment or services, internet or power failure, unauthorised modification, or a failure to follow instructions.
For a commercial customer only, and so far as the law permits, BlueMax is not liable for indirect or consequential loss, loss of profit, revenue, business, anticipated savings, goodwill or data. BlueMax’s aggregate liability arising from a commercial contract will not exceed the total price paid or payable under that contract, except for liability that cannot lawfully be limited.
CCTV is a risk-management tool, not a guarantee against crime, loss, damage or liability. Customers should maintain suitable physical security and insurance.
16. Force majeure
Neither party is liable for delay or failure caused by an event beyond its reasonable control, including severe weather, fire, flood, epidemic, transport disruption, utility or communications failure, industrial action, government action, civil disorder, import restriction or an exceptional supply-chain failure. The affected party must take reasonable steps to reduce the impact. If the event continues for an unreasonable period, either party may end the unperformed part of the contract, subject to payment for work and goods already supplied.
17. Intellectual property and software
BlueMax retains ownership of its quotations, drawings, survey methods, documents, website content and other original materials. The customer may use project documents for operating and maintaining the installed system but must not commercially reproduce or distribute them without permission.
Manufacturer software, apps, firmware and trademarks remain subject to their owners’ licence terms. BlueMax does not transfer ownership of third-party intellectual property.
18. Data protection
BlueMax processes customer contact and project information as described in the Privacy Policy. After handover, the customer will normally be responsible for recordings made by their CCTV system and must operate it in accordance with applicable privacy, employment and surveillance law.
19. General terms
If a court finds part of the contract invalid or unenforceable, the remaining provisions continue in effect. A delay in exercising a right is not a waiver. The customer may not transfer the contract without BlueMax’s written agreement, except where the law gives a right to do so. No person other than the customer and BlueMax has a right to enforce the contract under the Contracts (Rights of Third Parties) Act 1999.
20. Governing law and disputes
The contract is governed by the law of England and Wales. The courts of England and Wales have jurisdiction, although a consumer living elsewhere in the United Kingdom retains any mandatory right to bring proceedings in their home jurisdiction.
